1. Independent Contractor
The Tutor provides services as an independent contractor and is not an employee, partner, or agent of the Platform. The Tutor is responsible for all applicable taxes and legal obligations.
2. Services
The Tutor agrees to provide professional online English language lessons through the Platform, maintain high teaching standards, and comply with all Platform policies.
3. Tutor Responsibilities
The Tutor agrees to:
- Provide accurate profile information and qualifications.
- Conduct lessons professionally and on time.
- Maintain respectful communication with students.
- Protect student privacy and confidential information.
- Follow all Platform rules and quality standards.
4. Lesson Booking
All lesson bookings, scheduling, communication, and payments must be completed exclusively through the Platform.
The Tutor shall not request or accept direct payments from Platform students or encourage students to continue lessons outside the Platform.
5. Trial Lesson
The Platform may offer a one-time introductory trial lesson for new students with a Tutor.
The trial lesson shall have a duration of 25 minutes and shall be offered to the Student at 50% of the Tutor's regular lesson price.
The Tutor agrees that the trial lesson will be compensated based on the actual amount paid by the Student, after deduction of the Platform's agreed service commission.
6. Payments and Revenue Sharing
Students pay the Platform directly for all lessons booked through the Platform.
Lesson prices are standardized for all Tutors on the Platform: $5 USD for a 25-minute lesson and $10 USD for a 50-minute lesson. Tutors may not independently change these prices.
The Platform shall retain a 25% service commission from the lesson fee as compensation for providing platform services, including student acquisition, technology infrastructure, payment processing, marketing, and administrative support.
The Tutor shall receive 75% of the lesson fee as their teaching compensation.
Tutor Payment Method
Tutors will receive payment for completed lessons on a weekly basis through Queens Kids Talk. Payments will be calculated based on completed and confirmed lessons after deducting the Platform commission and any applicable transaction fees.
Tutors must provide accurate payment details. Direct payments from students outside the Platform are not permitted.
The Tutor acknowledges and agrees that the Platform's commission percentage may be updated in the future upon prior notice to the Tutor.
7. Cancellation Policy
Either party may cancel or reschedule a lesson without penalty if the cancellation is made at least 24 hours before the scheduled lesson.
If a Student cancels less than 24 hours before the lesson, the lesson may be considered completed and the Tutor may receive payment according to the Platform policy.
If a Tutor cancels less than 24 hours before the lesson, the Student shall receive a refund or lesson credit, and the Platform may issue warnings or apply account restrictions for repeated violations.
8. No-Show Policy
A Student or Tutor who fails to join the lesson within 15 minutes of the scheduled start time without prior notice shall be considered a No-Show.
Student No-Show
- Lesson marked as completed.
- Tutor receives payment.
- No refund unless approved by the Platform.
Tutor No-Show
- Student receives a full refund or lesson credit.
- Tutor receives no payment for the missed lesson.
- Repeated violations may result in warnings, reduced visibility, suspension, or account termination.
9. Technical Problems
Where a lesson is interrupted due to verified technical issues beyond either party's reasonable control, the Platform may determine whether the lesson will be rescheduled, refunded, partially credited, or considered completed.
10. Confidentiality
The Tutor shall keep all student information and Platform business information confidential during and after this Agreement.
11. Intellectual Property
The Tutor retains ownership of independently created teaching materials.
The Platform may use the Tutor's public profile, ratings, lesson descriptions, and promotional content for marketing purposes.
12. Quality Standards
The Platform may monitor lesson quality through student ratings, complaints, attendance records, and performance indicators.
13. Platform Authority
The Platform reserves the sole right to investigate and resolve disputes relating to attendance, payments, cancellations, lesson quality, technical issues, or violations of this Agreement.
The Platform's decision shall be final.
14. Termination
Either party may terminate this Agreement.
The Platform may immediately suspend or terminate the Tutor's account in cases including, but not limited to:
- Fraud or dishonest conduct.
- Repeated cancellations or No-Shows.
- Receiving payments outside the Platform.
- Contacting Platform students for private lessons.
- Serious misconduct or violation of Platform policies.
15. Electronic Acceptance
By clicking “I Agree” during registration, the Tutor confirms that they:
- Have read and understood this Agreement.
- Agree to be legally bound by its terms.
